This is an English translation of our Portuguese terms of service (Termos de Serviço). If the two versions differ, the Portuguese version prevails.
Welcome to Zarpela. These terms govern travel agencies’ use of the platform. By creating an account or using the service, the agency accepts these terms. We wrote them to be read — without unnecessary legalese.
At this stage, Zarpela is operated by its founder as an individual (“Zarpela”, “we”). The operator’s full identification is available at any time on request. Contact: hello@zarpela.com.
1. The service
Zarpela lets travel agencies create digital itineraries and share them with their clients through trip pages carrying the agency’s brand — installable on the phone, working offline and updated in real time. The specific features depend on the plan taken out and are described at zarpela.com.
2. Accounts
Each account belongs to a travel agency. The agency is responsible for keeping its login credentials secure and for all activity carried out in its account. The account is intended for professional use by travel agencies and tour operators; it is not intended for consumers.
3. Content and the agency’s responsibility
The agency keeps all rights to the content it enters (itineraries, texts, images, documents, brand). By using the service, it grants us only the technical license needed to host that content and show it to its travelers — for nothing else.
The agency is responsible for: (a) having the right to use the content it uploads, including images and its brand; (b) the accuracy of the travel information shown to its clients; (c) handling its travelers’ personal data lawfully — the agency is the controller of that data, and Zarpela acts as a processor under the Privacy Policy, which forms part of these terms.
Using the platform for illegal, misleading or malicious content, or trying to access other agencies’ data, is prohibited.
4. Plans, prices and payment
The plans and prices in force are published at zarpela.com. Payment is made by card, on the platform, through Stripe, which handles the card details; Zarpela neither receives nor stores them. Where agreed in writing, billing is by invoice, paid by bank transfer. Prices may be updated with reasonable prior notice — never in the middle of a period already paid for, and founding-partner conditions agreed in writing prevail over the public price list.
The subscription starts on activation; trial periods, when agreed, are set out in the written conditions.
5. Availability of the service
We are committed to keeping the service available and actively monitor how it is running, but we do not guarantee uninterrupted availability. Planned maintenance will, wherever possible, be done outside working hours. Trip pages were designed to work offline on the traveler’s device once opened with internet — an extra protection against occasional outages.
6. Cancellation and termination
The subscription renews automatically for equal periods (monthly or yearly, as contracted) until it is canceled. The agency may cancel at any time, with effect at the end of the paid period. We may suspend or close accounts that breach these terms, with prior notice except in serious cases. After closure, trip links stop working and the data is deleted under the Privacy Policy. Before deletion, the agency may ask for a copy of its data.
7. Limitation of liability
The service is provided “as is”. To the fullest extent permitted by law, our total liability to the agency is limited to the amount paid by the agency in the 12 months before the event. We are not responsible for the content of the trips (which is the agency’s) or for indirect damages. Nothing in these terms limits liability that cannot be limited by law.
8. Changes to these terms
We may update these terms; relevant changes will be communicated to agencies by email with reasonable notice. Continued use after they take effect constitutes acceptance.
9. Governing law
These terms are governed by Portuguese law. Jurisdiction: the Portuguese courts.
